President Bola Tinubu has directed the Economic and Financial Crimes Commission (EFCC) to approach the court and vacate its order freezing the bank accounts of the Osun State Government, citing concerns over the timing of the enforcement ahead of the state’s upcoming election.
The directive follows a growing controversy between the anti-graft agency and the Governor Ademola Adeleke-led administration after the commission secured a “Post No Debit” court order on August 5, 2026, amid an investigation into alleged financial mismanagement.
Concerns Over Electoral Integrity
In an official statement released on Thursday, President Tinubu addressed the situation, noting that while the EFCC has a constitutional mandate to investigate financial crimes, federal institutions must avoid actions that could undermine public trust in the democratic process.
With the Osun State governorship election scheduled to take place in a matter of days, the President emphasized that maintaining public confidence in the fairness of the electoral process outweighs the immediate operational timing of the investigation.
“Preserving public confidence in the credibility and fairness of the election is of greater public interest,” the statement highlighted, noting that actions taken by federal agencies close to elections are often misconstrued as political intervention.
Neutrality and Institutional Independence
The President reiterated that his administration maintains a policy of non-interference regarding the operational activities of law enforcement and security agencies.
He clarified that he had not been fully briefed on the specific circumstances that led to the court filing but determined that an immediate withdrawal of the restriction was necessary given the political calendar.
Under the executive directive, the EFCC is required to return to court immediately to vacate the account freeze and suspend pending court actions related to the Osun State Government’s operational accounts.
Context of the Dispute
The directive comes shortly after the Osun State Government strongly rejected the EFCC’s claims of an ongoing probe into ₦11 billion in public funds, characterizing the account freeze as an attempt to disrupt state operations ahead of the polls.
As of the time of publication, the EFCC has not issued an official response regarding the President’s directive or its timeline for filing the court application to lift the restrictions.
